A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Crimes related to the application for a loan of a lot capital;
A. On April 22, 2014, the Defendant: (a) indicated in the loan application form stating that “D (E) applies for a loan of KRW 6 million to a lot Capital; and (b) signed D’s name on the next page without authority to use the loan in the “C” page located in Ansan-gu, Ansan-si; and (c) submitted to the person in charge where the name of a lot capital is unknown, regardless of the fact that the loan was forged.
For the purpose of uttering, the Defendant forged a private document, which is a private document on rights and obligations without authority, and used a forged private document.
B. Around April 22, 2014, the Defendant: (a) lent KRW 6 million to a person in charge where the name of the victim’s slot Capital is unknown while doing so as if he/she was D; and (b) borrowed KRW 6 million to repay the principal and interest each month for a period of three years.
“The” submitted a loan application as stated to the effect.
However, the defendant was not the above D, and there was no intention or ability to repay the principal and interest.
As above, the Defendant, by deceiving the victim, was given KRW 6 million from the victim on April 23, 2014.
2. Crimes related to the application for a loan from an ASEAN;
(a) No person shall unlawfully use another person’s resident registration number on or around May 16, 2014;
Nevertheless, the Defendant applied for a loan to a social loan (state) by using the Defendant's mobile phone at a place where the location is unknown on May 16, 2014.
In this respect, the defendant used another person's resident registration number unlawfully.
(2) No person committing a crime around May 28, 2014 shall unlawfully use another person’s resident registration number.
Nevertheless, it is not possible.
