The appeal is dismissed.

The grounds of appeal are examined.

Examining the reasoning of the lower judgment and the reasoning of the first instance judgment maintained by the lower court in light of the records, it is justifiable for the lower court to maintain the first instance judgment that acquitted the Defendant on May 10, 2013 of the instant facts charged, on the grounds stated in its reasoning, on the ground that there was no proof of crime. In so doing, contrary to what is alleged in the grounds of appeal, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules,

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
