1. The instant lawsuit shall be dismissed.

The capacity to judge the legality of the instant lawsuit refers to the mental ability or intelligence in which a reasonable determination can be made based on the meaning or consequence of the instant lawsuit’s act based on normal perception and history. As such, whether a person has a capacity to act ought to be determined individually in relation to a specific juristic act, and in particular, in order to recognize a capacity to act in a case where a certain juristic act is given with a special legal meaning or effect that makes it difficult to understand only the general meaning of the act in question, it should be understood not only as a day-to-day meaning of the act

(2) On January 15, 2009, when considering the overall purport of Gap evidence 3-1, 2, and Eul evidence 4, the plaintiff served as a flight crew member of the late 1980s. On November 25, 1989, the plaintiff was a fire to a gas due to the gas defect. At the time of the accident, the plaintiff contributed to the escape of passengers. However, the plaintiff suffered a big mental shock, and began to show symptoms of the mental fission, and the plaintiff was hospitalized for a long time in the Gangwon-Seoul Hospital, the Korean Mental Health Care Hospital, and the National Mental Health Care Hospital, etc. (see Supreme Court Decision 2008Da58367, Jan. 15, 2009). In light of the overall purport of Gap evidence 3-1, 2, and Eul evidence 4, the plaintiff had been hospitalized for a prolonged period of time from the above accident, and the plaintiff was present at the F Hospital located in Chungcheongnamnam-gun Hospital to the end of 25 years, and the plaintiff raised the engine as soon 13,20000 million.

In full view of these facts, the plaintiff is legally entitled to the lawsuit of this case due to mental fission.
