A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 16, 2018, at around 01:23, the Defendant entered a corrected external entrance door, which was installed in order to limit the outside person’s entry under the influence of alcohol in a free shop B, which is a woman dormitory of the Si University, Si University B, Busan, and had weak capacity to discern things or make decisions, followed by female students living in the said dormitory, and intruded with up to three floors from the elevator inside the said dormitory.

The defendant, while returning to the third floor of the corridor, coloring the object of the crime by leaving a dormitory visit, cutting down a dormitory, etc., and tried to find out the victim D (Ga name, boarding, 20 years of age) who is going out of the stairs between the third floor and the fourth floor of the building on the same day at around 01:46 on the same day, and to rape the victim.

그 다음 피고인은 피해자의 뒤로 다가가 갑자기 피해자가 메고 있던 가방을 잡아당기며 “사랑해”라고 하면서 키스하려고 하고, 이에 놀란 피해자가 거부하자 혀로 피해자의 얼굴을 핥았다.

계속하여 피고인은 “살려주세요”라고 소리 지르며 반항하는 피해자에게 “조용하라”고 하면서 손으로 피해자의 입을 막고, 힘이 빠진 피해자가 바닥에 주저앉자 피해자의 등 위에 올라타 피해자의 몸을 만지면서 계속 그 얼굴을 핥고, 숨이 막힌 피해자가 피고인의 손을 물자 한 손으로는 피해자의 머리를 수회 때리고 다른 손으로는 다시 피해자의 입을 틀어막으려고 하면서 피해자가 도망가지 못하도록 더 세게 피해자의 몸을 누르던 중 이상한 소리를 듣고 주변을 살피던 다른 거주자에게 발각되는 바람에 간음하지 못하고 피해자에게 치료일수 미상의 치아 탈락 등 상해를 가하였다.

Accordingly, the defendant invadedd the dormitory in which the victim is living and tried to rape the victim, and inflicted an injury on the victim.
