A defendant shall be punished by imprisonment for four months.

피고인과 A은 2012. 1. 18. 04:30경 원주시 G에 있는 피해자 E(29세)이 운영하는 ‘H’ 주점 앞길에서 위 주점 영업을 마치고 나오던 피해자가 피고인과 A에게 “안녕하세요”라고 인사를 하자 A은 “뭐 안녕하세요 내가 니눈에는 안녕해 보이냐 씨발놈아”라고 욕설을 하면서 피해자가 그동안 자신의 전화를 받지 않았다는 이유로 주먹으로 피해자의 얼굴을 수회 때리고, 그곳에 놓여있던 빨간색 라바콘으로 피해자의 얼굴을 3회 때리고, 피고인은 피해자에게 “너 내가 누군지 알지, 이 개새끼 너 신고하러 온 거냐 배때기를 회칼로 쑤셔버린다, 너 내가 깡패인줄 알아 몰라, 동생들 시켜서 가게 다 부숴버리고 장사를 못하게 하겠다, 너 이새끼 토막내 버린다”라고 욕설을 하면서 손으로 피해자의 멱살을 잡아 흔들고, 발로 피해자의 배 부분을 3회 걷어찼다.

The Defendant and A assaulted the victim in common as above, thereby causing bodily injury to the victim, such as each part of the upper mouths, which requires approximately 42 days medical treatment.
