A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is a person who actually manages the above gas station as a gas station C in Yeongdeungpo-gu, Suwon-si.
1. No person who violates the Petroleum and Petroleum Substitute Fuel Business Act shall manufacture, import, store, transport, store or sell fake petroleum products;
Nevertheless, at around 08:30 on June 13, 2019, at around 08:30, the Defendant: (a) provided 35 L via a passenger car operated by himself/herself by his/her name in the gas station No. C; and (b) caused an accident of mixing gasoline and diesel by mixing it with approximately 7:10; and (c) deducted about 50 L by mixing gasoline and diesel with approximately 7:10 in the foregoing vehicle.
When keeping them in custody, the above mixed oil was reusable and sold.
Accordingly, the Defendant, at around 20:05 on the same day, sold approximately 50 L of the same mixed oil mixed with gasoline and diesel to many unspecified customers at around 0.07%, and sold approximately 31,480 L of the same kind from around 20:07 to around 09:01 on June 22, 2019, using the same method as in the daily table in attached Form 951, which is mixed with gasoline to approximately 0.07%.
2. On June 13, 2019, the Defendant: (a) around 20:07, the Defendant: (b) was the nameless customer visiting the gas station to serve as a gas station; (c) and (d) gasoline sold through gasoline brewing around 0.07%, as described in paragraph (1). However, even though the Defendant was a fake petroleum product with approximately 0.07% of light oil, without notifying the above circumstances, the Defendant was charged with selling the normal gasoline; (d) the Defendant was given KRW 50,000 from the nameless customer to the name-free customer, and (e) from that time, the Defendant was given KRW 50,00 of light oil in the same manner as the daily list in attached Form from June 22, 2019 to June 22, 2019, and in the same manner, around 951.
