1. The plaintiff's supplementary intervenor's application for participation shall be dismissed.

2. The defendant shall pay 170,000,000 won to the plaintiff and this shall apply.

1. Basic facts

A. The Plaintiff is an association establishment promotion committee under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”) composed for a housing reconstruction project of Seocho-gu Seoul Metropolitan Government.

B. On December 2001, the Plaintiff lost its validity due to the expiration of its term of validity and became in a situation where no operating regulations exist.

C. Around June 2010, the Defendant participated in a bid to select a management entity specialized in improvement projects (hereinafter “maintenance business entity”), and paid KRW 200,000,000 as a loan to the Plaintiff and KRW 30,000,000 according to the bidding conditions.

On July 13, 2010, the Plaintiff: (a) held a residents’ general meeting on July 13, 2010; (b) proposed ten items, including the cases of operating regulations (the agenda item No. 1); (c) the cases of selecting a rearrangement business entity (the agenda item No. 8); (d) the cases of entrusting the conclusion of a contract to a designated subcontractor (a rearrangement business entity) (the agenda item No. 10); (c) and (d) Articles 5 (Implementation, etc.); (d) 21 (Resolution, etc.); and (e) Articles 28 and 29 (Selection and Contract) of the instant operational regulations as the grounds for the resolution of the agenda item No. 10 (the method of resolution of the residents’ general meeting); and (e) Articles 28 and 29 (Selection and Contract of Service Entities) of the instant operational regulations as the grounds for the resolution of the agenda item No. 8.
