Defendants are innocent.
Reasons
1. The E hospital in Seongbuk-gu Seoul Metropolitan Government is a so-called office hospital in Seongbuk-gu and operated normally, such as facilitating entry, discharge, and unauthorized going out of the hospital, and verification of hospitalization for patients even if the hospital did not actually be hospitalized.
A. Defendant A filed a claim for insurance proceeds with the victim Samsung Life Insurance Co., Ltd. on the ground that he was hospitalized in the hospital from January 6, 2014 to January 27, 2014, but did not have undergone normal hospitalized treatments, such as frequently going out of prison, during the aforementioned period. The Defendant, as above, was urged by the victim, and received KRW 950,00 from the victim for the purpose of hospitalization around February 10, 2014, and received KRW 21,705,980 from the victim by repeatedly hospitalized in total nine times, such as the time table of the crime committed in attached Table (1).
Accordingly, the defendant was informed of the victims and received property as insurance money.
B. Defendant B from January 22, 2014 to the same year
2. Until November, 200, the victim KB non-life insurance company filed a claim for insurance money with the victim KB non-life insurance company on the ground that the Defendant had been hospitalized in the E hospital, but did not have received normal hospitalized treatments from time to time during the above period, such as from time to time going out of the hospital. As above, the Defendant was granted KRW 29,338,007 of the insurance money by deceiving the victim as above and receiving KRW 210,00 from the victim under the pretext of hospitalization around February 20, 2014 as well as by repeatedly hospitalized the amount of KRW 29,38,007 in total nine times as in the list of crimes in the attached Form.
Accordingly, the defendant was informed of the victims and received property as insurance money.
2. Determination
A. “Hospitalization” refers to the conditions of nutrition and food taken in cases where continuous observation by a medical personnel is necessary in relation to the side effects or incidental effects of drugs, which have very low resistance to or are administered by the patient’s disease.
