Reasons
Criminal facts (defendant A and B) G hospital located in Seongbuk-gu Seoul Metropolitan Government F is a hospital operated normally, such as facilitating entry into, discharge from, and unauthorized going out and staying out of, the so-called office hospital, and providing confirmation of hospitalization to patients even if no actual hospital was conducted.
1. Defendant A claimed insurance money to the victim KB non-life insurance company on the ground that he/she was hospitalized in G hospital from January 13, 2015 to February 2, 2015, but did not have been actually hospitalized due to the absence of a doctor’s medical treatment during the above period. However, Defendant was given KRW 6,157,970 as insurance money by repeatedly hospitalized three times in total, such as the list of crimes (1), including by deceiving the victim and receiving KRW 1,130,570 from the victim on February 9, 2015.
Accordingly, the defendant was given property under the name of insurance money by deceiving the victim.
2. Defendant B filed a claim for insurance proceeds with G hospital from June 13, 2014 to June 26, 2014, on the ground that the Defendant was hospitalized in G hospital. However, the Defendant did not have received substantive hospitalized treatment, such as having received medical treatment during the above period. However, the Defendant was given KRW 3,673,526 by deceiving the victim as above and receiving KRW 1,149,075 from the victim on July 23, 2014, and by repeatedly hospitalized two times in total as shown in the list of crimes in the attached Table (2).
Accordingly, the defendant was informed of the victims and received property as insurance money.
