A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

The defendant is the actual president of E, and F is a person who operates G as a branch between the defendant and the death penalty.

F From June 25, 2007 to July 27, 2010, from the Seoul Livestock Industry Cooperatives (hereinafter “the Livestock Industry Cooperatives”) established a collective security right equivalent to the total amount of KRW 4.13 billion for the 1st real estate listed in the attached Table, such as Chungcheongnam-gun H, Chungcheongnam-gun H, etc. owned by itself, and received loans of KRW 4.837 billion for facilities for construction of G livestock pens and did not repay its debts. An agricultural cooperative (hereinafter “CF”) received a collective security right of KRW 15,22,970, KRW 300,000,000 from 36,000,000 from 36,000,000 won for the 1st real estate listed in the attached Table, and received a decision of KRW 306,000,000,000 from 36,000,0000 won for each of the real estate auction on May 16, 2011.

However, in fact, the above contract was drawn up in installments. From January 17, 2008 to December 15, 2010, the Defendant received the payment of construction cost equivalent to KRW 1.27,802,000,000 from the account in the name of “K (E)” which manages the funds from “F (G)” to the account in the name of “K (E)”, and the Defendant received the payment of construction cost equivalent to KRW 1.27,802,000,000,000 from the above false lien report, and the Defendant was found to have received the said payment due to the lack of the bidder on the date of sale of the said real estate due to the above false lien report.

Accordingly, the defendant has harmed the fairness of auction by fraudulent means.
