1. The plaintiff's claim is dismissed.
2. Of the costs of lawsuit, the part pertaining to the participation shall be borne by the Intervenor.
Reasons
1. Basic facts
A. The Plaintiff, the Plaintiff’s Intervenor, and the Defendant are companies running wholesale and retail business of electronic parts.
The Plaintiff and the Plaintiff’s Intervenor supplied chips to the Defendant, on the other hand, the Defendant supplied chips supplied by the Plaintiff, the Plaintiff’s Intervenor, etc. to ubiquitous quotas Co., Ltd. (hereinafter “schips”), and the chips supplied by the Plaintiff, the Plaintiff’s Intervenor, etc. were supplied to the Defendant, and the chips were produced by supplying the chips to the outsourcing or the chips to be supplied to the company by the external company using the chips from the external company.
B. On January 5, 2015, the Plaintiff’s Intervenor supplied chips 83,000 (name CL32B106KJNE, lot No AAPOF1, hereinafter “chips of the instant Plaintiff supply”). On the same day, the Plaintiff supplied the Defendant, and the Defendant supplied the quota on January 6, 2015.
C. On January 7, 2015, the Plaintiff’s Intervenor supplied chips (name CL32B106KJNNE, lot No. AAPOF1, hereinafter “the primary supply chips of the Plaintiff’s Intervenor”) to the Defendant on January 8, 2015.
On January 19, 2015, the Plaintiff’s Intervenor supplied 221,000 chips (name CL32B106KJNNE, lot No. AA9006M, hereinafter “chips of the secondary supply of the Plaintiff’s Intervenor”) to the Defendant on January 21, 2015, and the Defendant supplied them to the quota on January 21, 2015.
E. On January 23, 2015, the quota was known of the issue of the verified chips during the production of the product in the external company by using the chips supplied by the Defendant to the Defendant, and on January 24, 2015, the Defendant requested an analysis of the chips (one thousand of chips, one thousand of chips, a name CL32BB106K JNE, one total chip No. A9006M) and seven of chips (one total chip No. AA9006M) pointed out that there is a problem with the Samsung Electric Co., Ltd. (hereinafter “T”) on January 24, 2015. The Defendant requested an analysis of the chips (one thousand chips, one thousand chips, one thousand chips, one chips, one chip A906M) on January 28, 2015.
