피고인은 2013. 4. 5 21:30경 정읍시 F아파트 입구 노상에서 위 지구대 소속 G이 신고 내용에 따른 사건 발생 경위 및 인적사항을 묻자 "야 씨발 놈들아 너희들이 경찰관이냐 이 짭새 새끼야"라고 욕설을 하였다가 위 지구대로 임의동행을 요구하는 G의 왼쪽 허벅지를 발로 1회 걷어차고, 눈 부위를 머리로 1회 들이받았다가 출동 경찰관인 H이 공무집행방해죄에 대한 현행범인체포사실 등을 고지하고, 위 G이 동행을 요구하자 또다시 욕설과 함께 G의 허벅지 부위를 발로 걷어찬 후 땅바닥에 들어 누워 위 출동 경찰관들에게 수회 발길질을 하다가 위 지구대 소속 I 순찰차량을 타고 이동 중 H의 왼쪽 팔을 물어뜯는 등 폭행하였다.
