1. Defendant B’s KRW 4,086,00 as well as 6% per annum from March 3, 2015 to July 15, 2016 to the Plaintiff.
Reasons
1. Determination as to the cause of the claim against the defendant B, C, D, and F
A. The following facts do not conflict between the Parties:
1) The Plaintiff is running the active wholesale business in the name of “G” in the Jung-gu, Incheon. (2) Defendant B was supplied with active fish, etc. to the Plaintiff while operating a restaurant of “I” in the name of “H and 101 at the time of Pakistan.”
The accumulated amount of goods by March 3, 2015 is KRW 4,086,00.
3) Defendant C was supplied with active terms, etc. to the Plaintiff while running a restaurant with the trade name “K” on the J and the 1st floor of Pakistan-si. The accumulated goods amounting to KRW 5,983,00 by January 21, 2015 is KRW 5,983,00. 4) Defendant D operated a mutual restaurant with “M” as prescribed in heading L, 123, and 124 in Ilyang-dong-si, Ilyang-si, and was supplied with active terms to the Plaintiff from December 1, 2014 to December 30, 2014.
The accumulated amount of goods by December 30, 2014 is KRW 3,304,00.
5 Defendant F was supplied with active terms, etc. to the Plaintiff while operating a restaurant between the N, 1, 2 and O of the Namdong-gu Incheon Metropolitan City.
The accumulated amount of goods by December 4, 2015 is KRW 15,480,00.
B. According to the above facts, Defendant B calculated at the rate of KRW 4,086,00 per annum from March 3, 2015 to July 15, 2016, the delivery date of a copy of the complaint of this case; 6% per annum from July 15, 2016 to the delivery date of a copy of the complaint of this case; and 5,983,000 won per annum from January 21, 2015 to April 19, 2016 to the delivery date of a copy of the complaint of this case; and 6% per annum from the following day to the delivery date of a copy of the complaint of this case to the delivery date of a copy of the complaint of this case; 3,304,00 won per annum from July 15, 2016 to the delivery date of a copy of the complaint of this case to the delivery date of the complaint of this case; and 15% per annum from the delivery date of the complaint of this case to the delivery date of this case to 20.
