A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On January 15, 2007, the Defendant issued a summary order of KRW 5 million for a crime of violation of the Road Traffic Act at the Jung-gu District Court. On June 5, 2008, the Defendant was sentenced to a suspended sentence of KRW 8 months for a crime of violation of the Road Traffic Act. On January 28, 2011, the Defendant was sentenced to a suspended sentence of KRW 4 million for a crime of violation of the Road Traffic Act in the official state support of the Daejeon District Court.

The Defendant is a person who is engaged in driving of a C Poter cargo vehicle.

피고인은 2015. 7. 8. 22:30경 혈중알콜농도 0.115%의 술에 취한 상태로 위 화물차를 운전하고 대전 동구 D 소재 E주유소 앞 도로를 용전4가 쪽에서 중리4가 쪽으로 편도 3차로중 1차로를 따라 알 수 없는 속도로 진행하던 중 위와 같이 술에 취하여 보행이 비틀거리는 등 정상적인 운전이 곤란한 상태에서 운전한 업무상 과실로 전방에서 신호대기로 정차하고 있던 피해자 F(26세) 운전의 G 스포티지 승용차 뒷부분을 위 포터 화물차 앞부분으로 들이받고, 그 충격으로 위 스포티지 승용차가 앞으로 튕기면서 스포티지 승용차 전방에서 신호대기로 정차 중이던 피해자 H(51세) 운전의 I BMW 승용차 뒷부분을 위 스포티지 앞부분으로 들이받았다.

Thus, the defendant suffered from the victim F, the victim J(W, the 22 years old), K(n, the 23 years old), the victim H, the driver of the BMW car, and the victim L(the 51 years old) who was boarding the above car, respectively, for about two weeks of medical treatment.
