Punishment of the crime

[2013dan7794] On June 20, 2012, the Defendant made a false statement to the victim E in Gangnam-gu Seoul, Seoul, stating that “I lend money to the victim E as security for a real estate lease agreement of KRW 50 million.”

However, the fact is that the contract for the lease of real estate provided by the defendant to the victim was made up of false value, so there was no collateral value, and even if the defendant borrowed money from the victim, the defendant did not have the intent or ability

As such, the Defendant, as such, by deceiving the above victim, received delivery of KRW 17.9 million from the victim on June 25, 2012.

1. Around 03:00 on February 18, 2013, the Defendant: (a) prepared and printed the “Real Estate Lease Agreement, Seocho-gu Seoul F502, deposit KRW 20,000, KRW 2000, KRW 100, KRW 100, KRW 2000, KRW 100, KRW 200, KRW 100, KRW 200, KRW 200, and lessee’s agent of the lessor; and (b) signed and sealed the G’s seal prepared by

Accordingly, for the purpose of exercising, the Defendant forged one copy of the real estate lease contract in G name, which is a private document on rights and obligations.

2. On February 18, 2013, the Defendant: (a) exercised a forged real estate lease agreement at the coffee shop in Seocho-gu Seoul, Seocho-gu, Seoul, as described in the foregoing paragraph (1), with I who knew of that fact; (b) as if it was genuine.

3. The fraud accused, at the time and place indicated in the above paragraph 2, concluded a false real estate lease contract that was forged to the above victim I as above, and concluded that “If the defendant is the lessee in Seocho-gu Seoul, Seocho-gu, which is the lessee in KRW 502,00,000,000,000,000 won is lent, he/she would offer the above security deposit amount of KRW 20,000,000.”

However, the above lease contract was forged by the defendant, and the defendant was at the time.
