A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 2015, the Defendant, at the Defendant’s house located in Geumcheon-gu Seoul, Geumcheon-gu, 205 Dong 2701, had a sexual intercourse with the victim C, and took a photograph of the sexual intercourse with the content that the body of the victim was revealed by using the camera located in smartphones.

이후, 피고인은 2015. 12. 25.부터 2016. 2. 16.까지 사이에 위 장소에 있는 피고인의 집에서 피해자가 자신과 헤어진 후에 주변사람들에게 자신의 욕을 한 것에 화가 나 자신의 스마트 폰을 이용하여 ‘D’ 인터넷 사이트에 피고인 명의로 개설된 아이디로 접속한 후 ‘ 씨 팔 년이 지가 걸레 짓 해 놓고 당당하게 협박질 하네’ 라는 글과 ‘E ^^’ 이라는 제목으로 위와 같이 촬영한 동영상에서 피해자의 음부가 나타난 부분을 스마트 폰으로 캡처한 사진을 게시한 것을 비롯하여 별지 범죄 일람표 [1] 기 재와 같이 총 6회에 걸쳐 피해자를 모욕하는 글과 사진을 자신의 D에 게시하였다.

As a result, the Defendant displayed images of the victim’s body, which might cause sexual humiliation or shame by using a camera or other similar mechanism, openly against the victim’s will, and openly displayed obscene images.
