Defendant shall be punished by a fine of KRW 1,500,000.
If the defendant does not pay the above fine, 50,000 won.
Reasons
Punishment of the crime
1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and photographing);
A. On April 22, 2011, at around 22:01, the Defendant used the Defendant’s mobile phone shooting function to take the victim’s personal body against his will during the Defendant’s house located in Daegu Agu, 101, 509 Dong 509, while the victim C (her female, 39 years old) used the Defendant’s mobile phone shooting function.
B. On October 23, 2011, at around 00:17, the Defendant taken the part of the victim’s chests against his will using the victim’s cell phone photographing function between the victim C and the victim’s cell phone photographing at around 00:17.
C. On February 2, 2012, around 02:52, the Defendant taken the victim C’s negative part and chests against his/her will by using the recording function of the mobile phone owned by the Defendant in the EMoel 304 room located in Daegu-gu, Daegu-gu, Daegu-gu.
Accordingly, the defendant taken the body of another person, which could cause sexual humiliation or shame, against his will, using a camera.
2. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Distribution of obscenity) shall distribute or openly display obscene codes, letters, sound, images, or motion pictures;
Nevertheless, the Defendant:
A. Around 12:00 on August 17, 2013, at the Defendant’s home located in Daegu Birstion 101, 509, taken as described in paragraph 1(c) at the Defendant’s home, the pictures of C taken as described in paragraph 1(c) were put up on the NAF bulletin board.
B. On August 22, 2013, around 07:52, at the Defendant’s house located in Daegu B Mandom 101 Dong 509, the pictures of C, such as paragraph 1(c), were written with the words “F” on the NAC bulletin board.
C. On August 22, 2013, around 19:31, at the Defendant’s house located in Daegu B Mandom 101, 509, as described in paragraph 1(c), written a photograph of C, which was taken by the Defendant’s house, as described in paragraph 1(c), with the words “F” on the NAP bulletin board.
Accordingly, the Defendant is obscene through the information and communications network.
