피고인은 ‘B 단체’ 소속 회원들과 서울 용산구 소재 미군기지 담벼락 등에 광고물을 붙이기로 공모하고, 2016. 2. 3. 19:00 경부터 20:30 경까지 서울 용산구 녹사 평대로 소재 녹사 평 역 2번 출구 앞 인도상에서 ‘C’ 이라는 집회 서명운동을 개최한 후, 녹사 평 역 2번 출구 인근 미군기지 담장 및 담장에 설치된 ‘ 미 군용시설 무단 출입금지 ’라고 적힌 경고 간판, 주변 광고물 게시대 측면, 가로등 기둥 등에 ‘ 용산 미군기지에 탄저균 있다 전해 라~!!’ 는 내용의 스티커 약 120매를 부착하였다.
