[Defendant A] The defendant shall be punished by imprisonment with prison labor for one year

Punishment of the crime

Defendant

A was sentenced to eight months of imprisonment by the Gwangju District Court on October 18, 2013 due to the establishment of gambling places, etc., and completed the execution of the sentence in the Gwangju District Court on November 8, 2013.

Defendant

B On February 12, 2014, he was sentenced to one year for the crime of opening gambling places in the Gwangju District Court, and completed the execution of the sentence in the Gwangju District Court on December 6, 2014.

Defendant

C was sentenced to six months of imprisonment for the crime of opening gambling places at the Gwangju District Court on October 18, 2013, and completed the execution of the sentence in the Gwangju District Court on October 28, 2013.

1. Defendant A, Defendant B, Defendant C, and Defendant D (Establishment of gambling place)

가. 피고인들의 공동 범행 피고인 A, 피고인 B은 윷을 던지는 사람( 속칭 ‘ 무사’) 2명을 지정한 다음 윷 도박에 참여하는 사람들에게 판돈을 받고 윷 도박이 끝나면 승자에게 돈을 건 사람들에게 판돈을 분배하여 주는 역할을 하고, 피고인 C는 윷 도박이 시작되기 전 윷 도박에 참여하는 사람들을 정리하고 윷 도박이 시작되면 윷판에 휴대용 손전등을 비추거나 윷 도박에 참여하는 사람들이 윷판에 들어가지 못하도록 주변 정리를 하는 역할을 하고, 피고인 D은 윷 도박이 시작되면 경찰 단속을 피하기 위해 윷 도박장 부근에서 망을 보는 역할을 하는 등 각자 역할을 분담하여 광주 동구 천 교( 광주 일고) 밑 등지에서 윷 도박장을 개장하여 판돈의 10%를 도박장소 개설 대가로 받기로 공모하였다.

피고인들은 공모하여 2016. 10. 18. 00:36 경부터 08:00 경까지 광주 서구 양동 시장 복개도로 오른쪽 다리 밑에서 위와 같은 방법으로 불상의 사람들 로 하여금 판돈을 걸고 윷놀이를 하게 하고, 그 판돈의 10%를 도박장소 개설 대가로 받아 영리를 목적으로 도박장소를 개설하였다.

B. Article 1(a) of the Criminal Procedure Act provides that Defendants A, C, and D shall commit joint crimes in collusion with each other from February 28, 2016 until June 23, 2016.
