A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On October 23, 2018, the Defendant: (a) took a fighting match from C to a policeman belonging to the Seoul Gangseo-gu Police Station B police box, who was called up with the Defendant on October 19:5, 2018; (b) took a fighting box from C; and (c) took a flash with C, while moving to a nearby taxi wharf, the Defendant took a bath to C without any justifiable reason under the influence of alcohol on the front side of the D apartment of Seoul Gangseo-gu, Gangnam-gu, Seoul; and (d) took a flash part of the breast part of the left part of the breast part of the breast part of the drinking part.
Accordingly, the Defendant interfered with the legitimate execution of duties of police officers C in relation to the prevention, control, and suppression of crimes.
Summary of Evidence
1. Application of Acts and subordinate statutes to the defendant's legal statement C of the police statement, which is related to the document F of the police statement;
1. Relevant Article 136 (1) of the Criminal Act, the choice of criminal punishment, and the choice of imprisonment;
1. Article 62 (1) of the Criminal Act;
1. The reason for sentencing under Article 62-2 of the Criminal Act is that the defendant recognized the crime of this case as substitute for the crime of this case and reflects the mistake. The crime of this case was committed by the defendant on the ground that the defendant was under the influence of alcohol, and the nature and circumstances of the crime of this case are not good. Considering the circumstances unfavorable to the defendant, the punishment as ordered shall be determined by comprehensively taking into account the following factors: the defendant's age, character and behavior, environment, motive and background of the crime, means and consequence of the crime, and the circumstances after the crime of this case, etc.
