A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

No person shall transfer or acquire any means of access in using and managing the means of access.

Nevertheless, on October 31, 2016, the Defendant listened to the statement that “I will operate a liquor company, pay for the payment of KRW 100,000 won per account,” from the person who has posted the high-profit Ababababab, and then will make payment to the bank account per account.” On the same day, the Defendant opened a bank account in the name of the bank account in Nowon-gu, Seoul Special Metropolitan City, in the name of the bank account (Account Number E) at the D bank located in Nowon-gu, Seoul Special Metropolitan City, with the registration certificate, seal imprint, copy of the register, and power of attorney, and then, issued three copies of the means of access to the above account from around the same day to March 7, 2017, as shown in the attached list of crimes.

Nevertheless, on September 27, 2017, the Defendant heard a proposal to the effect that “the head of a bank needs to pay KRW 100,000 per account in return for the opening of the account,” from the name unfortunateist who posted on the Internet advertisement of high-profit Ababababababa,” and accordingly, on or around September 26, 2017, the Defendant transferred the means of access to electronic financial transactions by issuing a bank account in the name unfortunateist box in the vicinity of Gangnam-gu Seoul Metropolitan Government, or a cash card connected to the passbook and account of the said company bank in order to pay KRW 10,00 per account.”
