A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. On May 2015, the Defendant: (a) at the French site, the Defendant: (b) called, “The Defendant acquired a restaurant building called V located in Gwangju-dong U and operated the restaurant; and (c) the Defendant said, “The Defendant: (a) 40,000 won is required to take over the restaurant; and (b) ivate, which bears KRW 25,000,000,000, shall invest KRW 15,000.”

However, the defendant did not have the intention or ability to prepare funds to take over a restaurant due to the absence of any particular property, and even if he received investment funds from the victim, it was not easy to take over the restaurant.

Nevertheless, the Defendant made a false statement as above and received KRW 8,00,000 in cash from the victim on June 5, 2015 and KRW 7,00,000 around June 15, 2015, respectively. The Defendant received KRW 600,000 from the Defendant’s account on June 22, 2015, and KRW 514,000 around June 24, 2015, respectively.

Accordingly, the defendant acquired 16,764,00 won in total as investment money by deceiving the victim.

2. At around 06:30 on July 13, 2015, the Defendant: (a) received a request from the Victim Y to “I withdraw KRW 300,000 in cash from a cash withdrawal machine from the cash withdrawal machine; and (b) made a withdrawal of cash from the Victim Y’s Trac Card Account with an opportunity to take out the victim’s cell phone with the passwords stored; and (c) made a withdrawal of cash from the victim Y’s Kac Card Account at around 07:20 on the same day, the Defendant continued to withdraw KRW 30,000 in cash from the cash withdrawal machine installed at the victim Y’s Kac Card Account; and (d) withdrawn the said 360,000 won in cash withdrawal from the cash withdrawal machine installed at the victim Y’s Mac Card’s Mac Card’s Mac Card’s Mac Card’s Mac Card’s Mac Card’s 364 on the same day.

Accordingly, the defendant is responsible for the cash withdrawal of the victim's name.
