Defendant shall be punished by imprisonment with prison labor for a period of ten months and by imprisonment for a case of heading 2019 order312 (Merger).
Reasons
Punishment of the crime
The defendant of "2019 Highest 312" is a person who has been in a relationship with the victim B.
1. Larceny;
A. At around 12:30 on January 23, 2016, the Defendant: (a) sought that the Defendant would lend money from a building in Changwon-si, Changwon-si; and (b) had talk with the victim on the part of the victim; (c) then, (d) had the victim talked with the victim on the part of the victim, he stolen one of the victim’s LG smartphone owned by the victim, equivalent to KRW 1 and 400,000,00,000, from the wall of the victim who used the cres that the victim did not have his house.
B. From 13:29 to 13:33 on the same day, the Defendant classified a password that was known prior to the use of the victim’s debit card in the cash withdrawal machine located in Changwon-si E, Changwon-si, and withdrawn KRW 6,000,000 in cash against the will of the manager of the cash withdrawal machine in the victim’s name and stolen it.
C. On April 25, 2016, at around 20:00, the Defendant stolen that the victim had been in custody of a newly issued bank debit card after being stolen from the above paragraph (a). At around 20:16, the Defendant continued to divide the password prior to the use of the victim’s debit card from a non-cash cash withdrawal machine located in the Changwon-si, Changwon-si, Changwon-si, and then withdrawn KRW 100,000 in cash against the will of the manager of the cash withdrawal machine in the name of the victim, from that time until April 29, 2016, the Defendant withdrawn KRW 3,500,000 in total eight times as shown in the list of crimes in the attached Table.
2. On February 18, 2016, the Defendant used computers, etc.: (a) received a request from the victim to withdraw KRW 200,000 in cash from the victim’s dwelling at around 19:00; (b) and (c) received the cash withdrawal from the HF association head and password in the name of the victim at around 19:31 on the same day.
