Defendant D is a representative director of the E Co., Ltd. who is in general charge of safety and health of employees and contractors employed by the E Co., Ltd., and Defendant C is a safety manager of the E Co., Ltd. who manages and supervises matters concerning safety of employees and contractors employed by the E Co., Ltd.

B A Co., Ltd. is a business owner who runs the business of plastic processed products using 13 workers with its head office in Kimhae-si, the second floor, and the defendant A is a person in charge of safety and health management responsible for the safety and health of his employees as the actual manager of the B Co., Ltd.

B Around January 1, 2018, Defendant E Co., Ltd. subcontracted work such as crowdfunding, tracking, inspection, packing from Defendant E Co., Ltd. to E Co., Ltd., and had its employees perform the work as E Co., Ltd. in the E Co., Ltd.’s workplace.

1. Defendant A (Violation of the Occupational Safety and Health Act);

(a) A business owner shall require a supervisor to check necessary matters, such as protective devices, booms, and click functions, the state of the place where he is passing through the wire, before commencing work using the set;

(b) No business owner shall use machinery, tools, equipment, protective devices, protective outfits, etc. that fail to take protective measures under Article 33 of the Occupational Safety and Health Act, safety certification standards under Article 34 of the same Act, autonomous safety standards under Article 35 of the same Act, and machinery, tools, equipment, protective devices, protective outfits, etc

Nevertheless, at around 13:47 on August 8, 2018, Defendant A had H, who is its employee, from the second floor of the gold department in the E-stock company’s place of business.
