피고인은 2011. 9. 7. 02:30경 대구 북구 E에 있는 F 주점에 들어가 그곳 종업원인 피해자 G(24세)에게 향촌동파 조직원임을 과시하며 “H, 누군지 알제 술값하고, 돈 20만 원만 줘봐라. 안 띠 먹는다. 내 알아두면 니한테 도움 된다. 앞으로 자주 보자”라고 말하여 피고인의 말을 듣지 않으면 피해자의 신체나 영업에 어떠한 위해를 가할 것 같은 태도를 보이며 협박하여 술과 안주 등 합계 60만 원 상당을 시켜먹은 후 피해자로부터 2회에 걸쳐 현금 40만 원을 교부받고, 계속하여 그 무렵 그곳 종업원인 피해자 I(20세)에게 손을 올려 때릴 듯한 태도를 취하며 “돈 20만 원 가지고 온나. 씹 할 놈아, 거짓말 하지마라. 금고에 있는 돈 봤다. 왜 거짓말 하노, 가지고 온나. 이 씹 할 놈, 돈 있으면서 왜 없다고 하노 임마”라고 협박하여 피해자 I로부터 2회에 걸쳐 현금 40만 원을 교부받았다.
