A Imprisonment for two years, Defendant B’s imprisonment for six months, Defendant C’s fine for KRW 3,00,000, and Defendant D’s fine for two years.

Punishment of the crime

Defendant

A worked for I branch offices of the Korea Rural Community Corporation from February 8, 2011 to September 30, 2014, and performed for the purpose of securing water resources and improving the agricultural environment in the said construction works, the J District (K and 13 Ri) was in charge of the work of paying compensation for farming losses to those who actually cultivate crops on land incorporated into a project site in accordance with relevant laws and regulations.

Defendant

A, after investing in the sports soil business, obtained bonds with failure, in order to raise funds for the full payment, A forged or falsely prepared documents related to compensation for farm losses so that compensation for farm losses can be paid unlawfully to those who are not entitled to receive compensation for farm losses, and had received the compensation from the recipient and received it to use it for the repayment of the debt.

Accordingly, Defendant A has difficulty in carrying out the project because the owners of the land incorporated into the J District project site were less compensated and they opposed to the incorporation.

Defendant C, Defendant D, Defendant E, and Defendant F, respectively, were introduced, on the ground that they were not actual farmers through Defendant B, by falsely stating that “A seal impression certificate, resident registration abstract, and farmland original copy, which are necessary for the payment of compensation, will be paid to those persons in the passbook, but an additional compensation will be paid to the owner of the land at the time when the compensation was paid, and the project will be promoted well.”

Defendant

B, Defendant C, Defendant D, Defendant E, and Defendant F received compensation from the Korea Rural Community Corporation even though they were not entitled to receive the compensation for farming loss, and subsequently, they intended to transfer the remainder of the money excluding the deposit fee to Defendant A’s wife L account under the direction of Defendant A, or to receive the refund of the deposit money after delivering it to Defendant A through Defendant B in cash.
