Punishment of the crime

Except as provided for in the Public Official Election Act, no one shall distribute or spread any newspaper or other publication that carries an article about the election in a way other than normal way.

1. Defendant A was the publisher of the newspaper “C” and the above newspaper was not published for 2015, but was mainly printed with 5,000 copies in total and 20,000 copies in total and 20,000 copies in the year 2017 and distributed to D/E government offices in a small amount or by inserting them in F in the D/E area. However, during the 2018 period, when the 7th local election was imminent, Defendant A published articles related to the above newspaper with an intention to exercise influence over the above election by means of mass distribution or spraying. The number of previous published copies exceeds the number of previous published copies, and exceeds 5,00 copies in total, 10,000 copies in total, 10, 200 copies in total, 10, 2000 copies in total, 10, 2018, 10, 205, 208, 2018 copies in total, 205, 2018.

On April 24, 2018, the Defendant distributed 270 copies of D local housing units, and 4,000 copies of D local housing units, apartment complexes, senior citizens using "N" cafeteria free of charge operated by the Defendant, through the following: (a) around April 26, 2018, the Defendant distributed 270 copies to C on April 24, 2018, carrying articles unfavorable to the D market candidate H (I) and I political parties under the item of "G"; and (b) C reporter J distributed 270 copies of D local housing units, and apartment complexes, using "N" cafeteria freely operated by the Defendant.

B. On May 25, 2018, the Defendant distributed C in relation to the D market election, around May 25, 2018, posted articles favorable to PP (PP) of the D market candidate, “O” as of May 25, 2018, and up to 1,400 R apartment complex.
