C On April 13, 2016, a person who was going to the first election district in the 20th election of National Assembly members on April 13, 2016, and was a person who was the first student of C, and Defendant B was a person who was in charge of certain management, etc. in the 20 election of National Assembly members.
Except as provided for in the Election of Public Officials Act, no one shall distribute, spread, post, or affix a newspaper, communication, magazine, or the organ of an institution, organization, or facility, or any other publication that carries an article related to an election, in a way other than ordinary methods, or distribute, spread, post, or affix such article by reproducing it.
Nevertheless, at around 13:40 on April 1, 2016, the Defendants conspired to indicate the part of the article in the title “M” published on L’s daily bulletin that “N Council members had caused 300 million won and demanded KRW 300 million in return for the convenience of corporate loans, etc.” and among the article in the title “P” published on the O’s daily news, “P” as well as the article in the title “P”, the Defendants presented a letter of commendation that recognized the contribution to the establishment of a volunteer culture and the development of the local community to the representative of the R Resource S., and then distributed approximately 200 copies of the article in front and rear the article in question to the employees of the above church in the way of distributing the article in the way other than the above list of Articles 1 and 200 through the method of distributing them to the employees of the above church (hereinafter “the instant printed article”).
