A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 7, 2015, the Defendant was issued a summary order of KRW 5 million for a violation of the Road Traffic Act, etc., in the Gwangju District Court’s Netcheon Branch, and on April 16, 2015, the Defendant was issued a summary order of KRW 4 million for the same crime in the same court.

1. On July 13, 2016, the Defendant was under the influence of alcohol on the violation of the Road Traffic Act and the Road Traffic Act (driving without a license). On July 20:13, 2016, the Defendant driven B Poter cargo without obtaining a driver’s license from the veterans center (Gu) parking area in Bosung-gun, Bosung-si to the front road of the land in the same Eup.

Therefore, even though the Defendant violated the prohibition of drunk driving more than twice, he again drives a motor vehicle while under influence of alcohol, and simultaneously drives a motor vehicle without obtaining a driver's license.

2. No motor vehicle owner who has violated the Guarantee of Automobile Accident Compensation Act shall operate any motor vehicle on a road which has not been covered by mandatory insurance;

Nevertheless, the Defendant operated the cargo vehicle stated in the preceding paragraph, which was not covered by mandatory insurance, at the time and place mentioned in the preceding paragraph, as stated in the preceding paragraph.

3. Any person who has acquired an automobile registered in violation of the Automobile Management Act shall file an application for ownership transfer registration with the Mayor/Do Governor as prescribed by Presidential Decree;

Nevertheless, on October 5, 2015, the Defendant did not file an application for the registration of ownership transfer of a motor vehicle even though he/she purchased and received the cargo vehicles listed in paragraph (1) from the land owner E in the D parking lot located in Gwangju metropolitan area.
