A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
The defendant is a deputy head of D Co., Ltd. who is a company that supplies multi-purpose excavation equipment entering the Defense Acquisition Program Administration, etc., and takes charge of quality control, etc.
1. On Apr. 1, 2008, the Defendant, who forged public documents, altered public documents, or altered private documents, failed to prepare a test report issued by an officially authorized agency to the Defense Acquisition Program Administration, which entered the multi-purpose excavation machine, and could not be supplied. On Dec. 13, 2007, the Defendant had been able to newly create and use the test report using the test report in the name of the Administrator of the Small and Medium Business Administration in Busan and Ulsan District Office (F) on Dec. 13, 2007.
피고인은 2008. 4. 초순경 부산 영도구 G에 있는 주식회사 D 사무실에서, 위 2007. 12. 13.자 원본 시험ㆍ분석성적서에 같은 글씨체로 미리 오려 둔 숫자 등을 풀로 붙이는 방법으로, 제목 란에 ‘시험성적서’, 신청인 성명 란에 ‘H’, 주민등록번호 란에 ‘I’, 주소 란에 ‘[J] 부산진구 K’, 상호 란에 ‘L’라고 기재하고, 시료명 란에 ‘고무판’, 시험방법 란에 ‘KS N 6518’, 접수일자란에 ‘2007년 12월 07일’, 시험완료일자 란에 ‘2007년 12월 13일’이라고 기재하고, 시험항목 및 시험결과 중 경도(Shore-A) 란에 ‘43’, 인장강도(N/㎟) 란에 ‘7.8’, 신장율(%) 란에 ‘420’이라고 기재하고, 문서 맨 아래 발행일 란에 ‘2007년 12월 13일’이라고 기재하여 다시 복사하였다.
