Reasons
Punishment of the crime
The Defendant is a civilian military employee of the United States Armed Forces in the Republic of Korea.
1. Around 01:10 on September 12, 2016, the Defendant driven a DNA car with a blood alcohol content of about 0.153% under the influence of alcohol on the 3km section from the roads near Young-gu, Daegu-gu, Daegu-gu, to the front roads of about 146 k-ro 146.
2. Violation of the Road Traffic Act (AFS) by the Defendant is a person who is engaged in driving a motor vehicle of Dclars.
At the time stated in the above paragraph (a), the Defendant driven the above Crller vehicle and proceeded the Frlur-do three-lane road in the south-gu Seoul metropolitan area E at a snife speed from the parallel distance to the parallel of the south-gu office distance.
At the third-lane of the road, the passenger car owned by the victim G(33 years old) and the JM5 car owned by the victim I(33 years old) were parked. In such a case, the driver of the vehicle has a duty of care to clarify the front side and prevent the accident by accurately operating the operation system of the vehicle.
Nevertheless, the Defendant neglected to do so and negligently led the Defendant to drive the car at the right part of the car of the Darler which the Defendant is driving, with the rear part of the Darler’s vehicle left part of the Darler’s vehicle, and due to the shock, the Defendant got the victim I, who was parked in front of the Dor’s vehicle while pushing the Dor vehicle in front and parked in front of the Dor’s vehicle.
Ultimately, the Defendant’s negligence in the above occupational negligence destroyed the JM5 vehicle repair cost to the extent that the lower part of the repair cost for the back of the HWz vehicle (vehicle scrapping, electric damage disposal), and attempted to stop immediately and abscond without taking necessary measures, even though it damages the amount equivalent to KRW 1,858,933 of the JM5 vehicle repair cost.
