피고인은 2018. 9. 16. 05:45 경 서울 강남구 테헤란로 132( 역 삼동 )에 있는 IBK 기업은행 테헤란로 지점 앞 노상에서, ‘ 동료가 술에 취해 택시를 태워 보내주려고 해도 꼼짝 안하고 있다 ’며 112 신고를 하였고, 서울 수서 경찰서 C 지구대 소속 경찰 관인 경위 D는 위와 같은 피고인의 112 신고를 받고 현장에 출동하여 피고 인의 일행을 깨워 보행이 가능한 것을 확인한 후 피고인과 피고 인의 일행에게 택시를 타고 귀가할 것을 권유하였다.
