1. Basic facts

A. On August 10, 2009, the Defendant entered into a lease agreement between the Plaintiff and the Plaintiff on the second floor of the steel frame C located in Ansan-si, the Plaintiff owned (hereinafter “instant building”) with the deposit deposit of KRW 30 million, monthly rent of KRW 1.3 million (including value-added tax), and the lease period of KRW 1.3 million from August 22, 2009 to September 1, 2014, and operated the automobile maintenance business office with the trade name D from the instant building.

B. On August 29, 2014, the Plaintiff and the Defendant concluded a lease renewal agreement between August 30, 2014 and August 29, 2016, setting the lease deposit and monthly rent as the same as the lease agreement stipulated in the preceding paragraph.

On August 30, 2016, the Plaintiff and the Defendant concluded a renewal contract for the instant building, setting the same as the lease contract specified in the preceding paragraph, monthly rent of KRW 1.4 million (including value-added tax), and the lease period from August 30, 2016 to August 29, 2018.

On August 18, 2018, the Plaintiff and the Defendant concluded a contract for renewal of the lease agreement between August 30, 2018 and August 29, 2020, setting the same as the lease agreement stated in the preceding paragraph, monthly rent of KRW 1.5 million (including value-added tax), and the lease period from August 30, 2018 to August 29, 2020.

Meanwhile, from around 2011, with respect to the size of 48,063 square meters of members E in Ansan-si, including the instant building, the housing reconstruction improvement project (hereinafter “the instant reconstruction improvement project”) under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”) was promoted. For this purpose, the housing reconstruction improvement project association (hereinafter “the instant reconstruction project”) was established, and the Ansan-si Mayor approved and announced the implementation of the instant reconstruction improvement project around 2015, and on May 4, 2018, the “the instant reconstruction project management and disposal plan (hereinafter “the instant reconstruction project”).
