A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) and the Road Traffic Act are those engaged in driving motor vehicles C;

On August 14, 2012, at around 22:15, the Defendant driven the said car without obtaining a driver’s license in the state of 0.339% alcohol concentration, and subsequently, was driving the said car in the Silsan-gu, Seogsan-gu, Silsan-gu, Silsan-gu, Silsan-gu, and followed the said car to the direction of the Ulsan-do from the direction of the deline movement.

Although a person engaged in driving service has a duty of care to safely drive a motor vehicle by taking the front side and left side well, the Defendant neglected to drive the motor vehicle in a situation where normal driving is difficult due to influence of drinking, and failed to properly drive the motor vehicle at the front time due to negligence, and thereby, received the rear driver of the motor vehicle in front of the motor vehicle in front of the traffic signal driven by the victim D(the age of 44) who stops in the front line.

Ultimately, the Defendant caused the victim F (the 35 years old), who is a passenger with the victim D and SP car, by such occupational negligence, injury to the victim F (the 35 years old), such as dynasium, which requires treatment for about three weeks, and at the same time, damaged the above SP car with the repair cost of KRW 4,802,244, such as the exchange of a spread.

2. On June 10, 2009, the Defendant violated the Road Traffic Act, the Road Traffic Act (driving without a license) and the Guarantee of Automobile Accident Compensation Act (hereinafter referred to as the “Motor Vehicle”) by having been sentenced to a summary order of 3.5 million won as a fine for a violation of the Road Traffic Act (driving without a license) in the Goyang Branch of the District Court of the Jung-gu District, which was sentenced to a summary order of 3.5 million won, and on January 25, 2011, the same court has been sentenced to a suspended sentence of 4 months for a violation of the Road Traffic Act (driving without a license) more than twice.

The Defendant is at least 0.339% of the blood alcohol concentration at approximately 5 km section from the front Do of the Ugpos farm in the Ug Seo-gu U.S.-dong dialogue at the time of the temporary competition in paragraph (1) to the place of the above accident.
