가. 폭행 피고인은 2014. 6. 11. 23:35경 고양시 일산동구 탄중로 430 중산마을 10단지 앞 사거리에서 위 승용차를 운행하던 중, C 그랜져HG 택시를 운전하면서 피고인을 뒤따라오던 피해자 D(남, 40세)이 피고인 앞에 정차한 승용차를 향해 아 빨리 진행하라는 의미로 경적을 울린 것을 피고인에게 한 오인하고 화가 나, 피해자에게 “개새끼야. 왜 빵빵거려. 운전 똑바로 해.”라고 욕설을 하고, 이에 피해자가 항의하자, 승용차에서 내려 피해자에게 다가가 주먹으로 피해자의 눈 부위를 1회 때리고 손바닥으로 피해자의 뺨 부위를 약 2~3회 때리고, 도주하려다 피해자에게 붙잡히자 주먹으로 피해자의 광대뼈 부위를 약 2~3회 때려 폭행하였다.

B.
