A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around July 8, 2018, the Defendant: (a) transmitted the screen screen of the victim C (nivers, 26 years of age) and sexually related ties to the victim D, E, and F, respectively; and (b) distributed photographs against the victim’s will.

No person who violates the Act on Promotion of Utilization of Information and Communications Network and Protection of Information shall allow any person to reach another person repeatedly in the form of code, words, sound, image, or picture creating fear or apprehension through an information and communications network;

그럼에도 불구하고 피고인은 2018. 6. 29. 21:39~22:16경 B 채팅방을 통해 위 피해자에게 “헤어지자, 나 못 참겠다. 나 가만히 안있는다. 그대로 갚아줄게, 니가 나한테 끼친거 야 너 나한테 다시는 연락하지마, ㅇㅋ 나한테 연락 노노 나도 너 역겨워 걸레같은 년아 그만하자, 너 소문이 왜 무서운지 알아 모르지 너 내가 좋게 끝내려고 했는데 니가 좆같이 구네, 사리분별 못하고 가랑이 벌리는 대걸레년 니가 말한 그대로네 전 남친 새끼들 찾아보고 헤어지자마자 다른새끼들 연락이나 하고 아 이거 완전 야 내가 사과 안하지 안해 ㅋㅋㅋㅋ 이게 진짜 개 또라이 쓰레기 걸레년이였는데 내가 또라이였다. 니같은애 깔리고 갈린 년을 만났네, ㅂㅅ년 넌그렇게 걸레처럼 살아라, 남자만 보면 사죽을 못쓰고 가랑이 벌리면서 야, 나이제 너랑 도저히 못해먹겠다.” 등의 메시지를 보낸 것을 비롯하여, 그 무렵부터 2018. 7. 27.까지 총 7회에 걸쳐 별지 범죄일람표 기재와 같이 위 피해자로 하여금 공포심이나 불안감을 갖게 하는 메시지를 반복적으로 보내 피해자에게 도달하게 하였다.
