1. The Defendant shall pay to the Plaintiff KRW 80,000,000 and the interest rate of KRW 15% per annum from February 23, 2016 to the date of complete payment.
Reasons
1.The facts following the facts of recognition do not conflict between the parties, or may be recognized by taking into account the whole purport of the pleadings in each entry in Gap evidence 1 to 10 (including the branch numbers if any).
The plaintiff is an individual entrepreneur who produces household appliances and produces household appliances with the trade name in C, and the co-defendant D is a company whose purpose is to conduct interior construction business, etc., and the defendant is a company director of D.
B. On June 4, 2016, the Plaintiff entered into a supply contract with D and E complex building construction site for fish processing and supply (price of KRW 60 million). (2) On July 6, 2016, the Plaintiff entered into a supply contract with D and E complex building construction site for the production and supply of household appliances to be used for D and E complex building construction site. (3) On July 6, 2016, the Plaintiff supplied household appliances around that time.
3) On July 6, 2016, the Plaintiff entered into an additional fish-processing production and supply contract (price 13.2 million) to be used for the new construction of the E Complex Building. C. Around August 2015, 2015, the Plaintiff supplied the Plaintiff with the terms of delivery. Around August 7, 2015, the Defendant’s main company D’s guarantee on the electronic bill, as the name of payment settlement for the above delivery case, and the name of payment settlement for the above delivery case, Ors Korea Co., Ltd., Ltd., issued on August 7, 2015, with the maturity date, KRW 80 million (i) the total face value of KRW 50 million in face value, ② the bill number of KRW 13.2 million in face value, and the Plaintiff demanded the Plaintiff to pay the above guarantee to the Plaintiff in the form of a notarized bill, and each of the Plaintiff had the capacity to pay the bill to the Plaintiff.
