1. Facts of recognition;

A. The plaintiffs are fishing village fraternities or individual fishermen engaged in community fisheries, fish farming, and fish farming, which are collected or captured by the tideland between the tidelands, fallens, noosess, scoos, etc. in the west-gun A coast, and in detail, plaintiffs 1 through 8 obtain a license and engage in fish farming (Provided, That the plaintiff 3 also engages in communal fishing business), and the rest of the plaintiffs are individuals who engage in fish farming after reporting to the Maritime Affairs and Fisheries Office and registering in the Maritime Affairs Register.

B. From June 30, 2003, the Defendant started removal, construction of D, road confirmation and packing works, and reclamation works for this purpose (hereinafter “instant construction”) of the existing D and Jeju Jeju National Road for road Nos. 13 and B-C through the Korea National Land Management Agency.

C. The Defendant requested the Korea Fisheries Research Institute to conduct a fishery damage investigation that may arise in neighboring fishing grounds due to the instant construction, and the Korea Fisheries Research Institute of the Korea Fisheries Research Institute of the Korea Fisheries University prepared a report on the impact of fishery damage (hereinafter “the report of the Korea Fisheries Research Institute”) around June 2004, after conducting an investigation from December 1, 2003 to May 30, 2004.

According to the report of the National Fisheries University, in the area of fishery damage caused by the instant construction works, the fishing ground on the north side of the Ydo-gun, including Ydo-gun E, F, G, H, I, and I, while the fishing ground on the north side of the Ydo-gun is included in the area of fishery damage caused by the instant construction works, the fishing ground on the north side of the YY-gun

E. On April 2006, the Plaintiffs: (a) requested the Korea Fisheries Research and Research Institute to investigate fishery damage; and (b) around September 2006, the report on investigation was prepared; and (c) according to the above investigation report, the fishing ground at the coast A in the south-gun coast was also included in the area of fishery damage.

F. The Plaintiffs filed the instant lawsuit on the basis of the report of the Busan National Land Management Office, which requested the head of the Busan National Land Management Office to compensate for damages.

(g) This Court shall establish a Institute for the Marine Science and Technology Industry of the Superior University on February 2011.
