Punishment of the crime
[criminal power] On June 15, 2016, the Defendant was sentenced to imprisonment with prison labor for 8 months and two months in prison with prison labor for night, intrusion upon residence, larceny, etc. at a leisure district court branch, and on November 29, 2017, the Defendant was sentenced to imprisonment with prison labor for larceny, etc. at the same court on November 18, 2018 and completed the execution of the sentence.
【Criminal Facts】
1. At night, around 00:30 on November 16, 2019, the Defendant: (a) intruded with a mail by the entrance opened in the “C” located in the Gyeonggi-si, Gyeonggi-si; (b) discovered and opened a malibu car, the victim D owner of the vehicle parked therein, and opened a malibu car not corrected; and (c) opened an inside, and cut off, one 2 million won per the market price, which includes cosmetics worth KRW 1,50,000,000, market price of which includes cosmetics owned by the victim.
2. On December 19, 2019, around 03:15, the Defendant: (a) intruded with the victim F, a victim F, in E-si in E-si, Gyeonggi-si; (b) discovered and opened an unsatisfy vehicle, the victim, who was parked therein, and opened an unsatisfy vehicle; and (c) entered the inside, and stolen the vehicle with a 30,000 won of the market price containing documents, such as a tax invoice, which is the victim’s ownership.
3. At around 04:10 on December 25, 2019, the Defendant: (a) discovered and opened an unrectton car, the victim H owner of the vehicle parked at G, Gacheon-si; (b) opened an unrecepted door; and (c) stolen KRW 3 cards, such as a slot card, and KRW 10,000 in cash, from the wall owner of the victim.
4. The Defendant violated the Computer, etc. Fraud and the Specialized Credit Financial Business Act: (a) around December 25, 2019, put the credit card in the H’s name, which was stolen, as described in paragraph (3), into the unmanned machine installed at the GJ located in Ischeon-si, Leecheon-si; and (b) input and settle KRW 14,00,00 of the prepaid amount.
