A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. The Defendant, along with C, D, and E, opened a mobile phone under the name of a person who did not intend to open and use the actual mobile phone, and conspired to dispose of the mobile phone to take profits therefrom.
Defendant was employed as a staff member of G, who is a cell phone sales store of the victim LG Puss Co., Ltd., in accordance with the above public offering on December 4, 2012 according to the above public offering.
E had E arbitrarily prepare a new contract of H’s mobile phone service in the name of H who has no intention to use the mobile phone, and then secured the process by e-mail and submitted to the above E a copy of the forged resident registration certificate under the name of the head of Nam-gu Incheon Metropolitan City Office of the Republic of South-gu, Incheon Metropolitan City, to the above E through e-mail, along with the forged mobile phone service new contract.
However, the Defendant and C, D, and E intended to dispose of the cell phone which was opened in H name, and the Defendant and C, D, E, and the above H did not have any intent or ability to pay the mobile phone usage fee and the mobile phone cost.
The Defendant, in collusion with C, D, and E, can receive mobile phone charges and mobile phone bills by deceiving the victim company, by applying for new services from the said H normally.
The trust acquired 87,205,80 won from the victim LG Plus Co., Ltd and SK Telecom Co., Ltd. in total from December 4, 2012 to January 29, 2013, and acquired 85 mobile phones equivalent to 97,205,80 won from the victim LG Plus Co., Ltd and SK Telecom Co., Ltd. in the same way as indicated in the list of crimes.
2. The Defendant in collusion with C, D, and E to the event of a forged official document, forgery of a private document, or the use of a falsified document shall be set forth in the list of crimes attached to the crime in the course of acquiring a mobile phone from the victim company as set forth in the above 1.
