A defendant shall be punished by imprisonment for four months.
Reasons
Punishment of the crime
1. On January 15, 2018, the Defendant, around 21:00 on January 15, 2018, issued a false statement to the victim D, “on the part of the Defendant, the Defendant: (a) opened a cell phone and sold the cell phone by doublephones after subtracting the core chip after opening the cell; and (b) opened two cell phoness in the Gong-dong-dong-dong-dong-dong-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si (hereinafter referred to as “the Defendant has given money to an agent who opened the cell phone-si-dong-si-si-si-si-si-si-si-si)” to the victim.
However, there was no money to be given to an agent who opened a mobile phone, and the defendant was thought to have received money from the victim and used it for living expenses.
As above, the Defendant deceptioned the victim, and acquired 840,000 won in cash from the victim on the same day.
2. Around January 20, 2018, the Defendant made a false statement to the effect that “Around January 20, 2018, the Defendant borrowed money to the victim before the F Official Points in Sinju-si, F.E., “I will pay off money. I will pay off money. I will pay off money.”
However, even if the defendant borrowed money from the victim due to no certain occupation or particular profit, he did not have the intent or ability to repay the borrowed money to the victim.
As above, the Defendant deceptioned the victim, and acquired 300,000 won in cash from the victim on the same day.
3. On April 13, 2018, the Defendant committed the crime: (a) around 20:00 on April 13, 2018, the Defendant stated that “The Defendant would have the victim collect money from a heavy chip after opening a chip, which is the same as the statement in paragraph (1).” (b) and that “the Defendant would have the victim collect money from a heavy chip, which is obtained after deducting the core chip after opening a chip,” and (c) the Defendant opened two cell phoness from two mobile phone agents located in the Si/Gu of Madong-dong and Yan-si, in 1.3 million won.”
