Reasons
1. Facts of recognition;
A. 1) The Plaintiff is a person operating studio rental business, and the Defendant, a person conducting construction business, was the Plaintiff first sent from the “R architect’s office” located in Q of Busan, on November 201, 201, to the introduction of the warden of the said office. 2) On November 201, the Plaintiff entered into a partnership agreement with the Defendant to construct a new building on the ground and jointly operate a leasing business (hereinafter “instant business”).
B. 1) The Defendant, who entered into a real estate sales contract, shows the Plaintiff’s business plan of “C Urban Residential Housing” and the “D Urban Residential Housing” as well as the business plan, and entered into a sales contract for each land as follows. A) On December 21, 2011, the Plaintiff and the Defendant entered into a sales contract with the Plaintiff on December 21, 201, with the following terms: (a) F-41 square meters (hereinafter “instant land”); (b) G substitute 60 square meters (hereinafter “instant land”); (c) the land buildings; and (d) the land buildings; and (e) the H road 2.5 square meters (hereinafter “instant land”); and (e) the sales price of KRW 210,000,000 on the date of the contract, intermediate payment of KRW 89,00 on January 10, 201; and (a) the remainder of KRW 100,000 on February 15, 2012.
B) On December 21, 201, the Plaintiff and the Defendant: (a) from I on December 21, 201, 60 square meters JJ of Busan-gu (hereinafter “instant third land”).
(C) On February 6, 2012, the Defendant concluded a sales contract with the content that, while jointly purchasing KRW 135 million for the purchase price, KRW 14 million for the contract deposit and KRW 30 million for the intermediate payment, KRW 91 million for the remainder on January 10, 2012, respectively, shall be paid as of February 7, 2012.) On February 6, 2012, the Defendant is obliged to purchase from T for the purchase of KRW 24 million for the purchase price and pay the said purchase price on the day of the contract.
