A defendant shall be punished by imprisonment for two years.

Seized evidence 2 through 7 shall be confiscated, respectively.

Criminal facts

No one shall use a trademark identical with the registered trademark of another person on the designated goods or similar goods, or use a trademark similar to the registered trademark of another person on the designated goods or similar goods, and any person who intends to conduct food subdivision business shall report it to the competent authority.

1. The Defendant: (a) performed a overall control over subdividing, distributing, financing, and packing of a fake C Old Round; (b) sold D and E to a subdivision factory; and (c) conspired in order to divide into a domestic part of a company into the designated goods with a registered trademark of C or any similar trademark; and (d) sold them to a subdivision factory.

In addition to D, from November 201 to January 2012, 2012, the Defendant: (a) subdivided China’s front door into 1 km; and (b) then then re-exported it to the “C Old Round” package containing a forged trademark like the registered trademark of the trademark right holder C; (c) packaged 10 km on the paper “C Old Round” paper with a forged trademark on which the forged trademark is marked; and (d) subdivided up approximately 8,00 boxes of fake C face value equivalent to 60 million won at the market price.

Accordingly, in collusion with D, the defendant used a trademark identical to the registered trademark on goods identical with or similar to the designated goods, and operated a food subdivision business without reporting it to the competent authorities.

2. The Defendant and D and E act as indicated in the preceding paragraph, and F act as supplying paper stuffs for double-domestic pathy and fake C old pathy, to a subdivision factory, G, H, I, and J act as subdivided work, and K act as a manufacturer of a double-domestic pathy pathy pathy pathy pathy pathy, without reporting to the competent authorities. It is marked with the registered trademark of C or any other similar trademark.
