Defendant shall be punished by imprisonment for a term of one year and six months.

One smartphone (No. 2) seized shall be confiscated.

Punishment of the crime

피고인은 2019. 10. 22. 입국한 말레이시아 국적의 외국인으로, 속칭 보이스피싱 범죄조직의 총책인 성명불상자 및 성명불상의 조직원들과 함께 불특정 다수인에게 전화를 걸어 수사기관을 사칭하여 금원을 교부받는 등 각종 보이스피싱 범행을 함께 하기로 마음먹고, 총책은 피해자금의 수금 및 송금방법 등을 지시하는 역할을, 성명불상의 보이스피싱 조직원은 피해자들에게 전화를 걸어 경찰관을 사칭하는 등 기망하여 돈을 교부하게 하는 역할을, 피고인은 위 총책이 휴대전화 메신저인 위챗으로 알려주는 장소에서 피해자가 두고 간 현금을 찾아 다른 조직원에게 전달하는 수금책 역할을 하기로 순차 공모하였다.
