The prosecutor's appeal is dismissed.

1. The decision of the court below on the gist of the grounds of appeal (one year of imprisonment and two years of suspended execution, etc.) is deemed to be too unhued and unfair;

2. The crime of this case is to purchase the sex of a juvenile whose perception of sex has not yet been fully formed. The crime of this case's sexual purchase is highly likely to be criticized in that it not only infringes on the human rights of the juvenile concerned, but also has a serious adverse effect on the establishment of the proper and sound sexual culture of society. The defendant's act of purchasing the sex of a juvenile is not limited only once, and it is bad that the defendant's act of purchasing the sex of a juvenile is not limited to one time, and the defendant does not have an attitude against him while denying the crime of this case, and the circumstance after the crime is not good after the criminal punishment is avoided is unfavorable to the defendant.

However, considering the circumstances favorable to the defendant, such as the fact that there is no history of punishment exceeding the fine imposed on the defendant, the juveniles appear to voluntarily respond to the defendant's sexual purchase proposal, and the fact that the defendant does not seem to have forced the juveniles to sexual intercourse, it does not seem that the court below exceeded the discretionary authority for sentencing on the grounds that considering all kinds of sentencing conditions stipulated in Article 51 of the Criminal Act, including the defendant's age, character and behavior, environment, motive and background of the crime, means and method of the crime, circumstances after the crime, etc., and the sentencing guidelines for the establishment of the Sentencing Committee.

Therefore, prosecutor's assertion is without merit.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
