A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. Around 14:00 on February 21, 2016, the Defendant: (a) was waiting for a victim F (the 22 years of age) who returned to the Defendant in front of a “E” restaurant located in Changwon-si, Changwon-si; (b) was waiting for a GaM7 car that did not contact the Defendant; (c) discovered the victim from the house at home in order to talk with the Defendant; and (d) stopped the victim in front of the victim; (c) had the victim’s cell phone and balth of the card so that the victim was forced to take aboard the vehicle, and had the victim take a form of card balth, so that he could stop from leaving the said vehicle at a speed of at least 10 meters by having the victim get off the said vehicle; and (d) allowing the victim to take off the said vehicle at a speed of at least 3 meters from the expressway to take off the vehicle at a speed of at least 10 meters to the direction of the victim to leave the expressway.
