A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From November 15, 2006 to September 21, 2011, the Defendant was in charge of the affairs of finance and accounting as the representative director of the Victim D Co., Ltd. (hereinafter “D”).

On January 4, 2011, the Defendant transferred KRW 100,000 from the Agricultural Cooperative (F) account in the name of the victim company in Geumcheon-gu Seoul Metropolitan Government to the account of Han Bank (G) in the name of the Defendant at the office of the victim company, and paid KRW 95,00,000,000 in total, including KRW 9,6 million on January 15, 201 and KRW 86 million on January 20, 201, and embezzled on October 26, 201 by using the leased deposit for personal purposes while in the course of business keeping the leased deposit in custody by returning KRW 95,00,000 from the lessor.

From January 4, 2011 to October 26, 2011, the Defendant embezzled total of KRW 795 billion on seven occasions, such as the list of crimes in the attached Table.

1. Around December 2010, the Defendant violated the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Violation of Information and Communications Network Utilization and Information Network Utilization and Information Protection Act, etc.) infringed on information and communications networks without legitimate authority, such as accessing the victim’s ID and password, which was known to the general public, to secure the circumstances of the victim J’s incompetence, etc.
