A defendant shall be punished by imprisonment for three years.

Punishment of the crime

1. The Defendant, from August 12, 201 to September 20, 201, transferred the purchase subscription amount of KRW 100 million and KRW 95 million to the same place from September 20, 201 to September 20, 201, at the office of the Co., Ltd. office of the Defendant’s management on the 7th floor of the Goyangdong-dong building B, Yongsan-gu, Seoul, and thereafter deposited each subscription amount of KRW 100,000,000,000 from the victim D, to the same place, from September 9, 2011 to September 20, 201, and deposited the purchase subscription amount of KRW 100,000,000 from the victim F to the account of DaS (GS) construction, the contractor, and kept each of the contract deposit for the victims.

Around that time, the Defendant embezzled a total of KRW 195 million, such as KRW 95 million stored for the victim D and KRW 100 million stored for the victim F, with the company’s operating fund, sales expenses of G hotel promoted by the Defendant, etc., and embezzled it by discretionary consumption.

2. From the above branch Es (GS) construction to November 201, the Defendant did not sell the above commercial building to individuals, and when the company owned and leased the commercial building and changed its policy to raise profits, the said company made a false statement to the effect that “The said company would make a return of KRW 100 million to each victims of the subscription amount received from the victim D through the Defendant, KRW 100 million, KRW 150 million, and KRW 250 million, the subscription amount received from the victim F, and KRW 250,000,000,000, which was remitted from the victim H, from November 14, 2011.”

However, at the time, the defendant could purchase the commercial building in question because he mentioned only the reference of the person in charge of GaS (GS) construction to review the request for a request to review the commercial building sale policy.
