A defendant shall be punished by imprisonment for not more than ten months.
Of the facts charged in the instant case, the fraud against the victim C is acquitted.
Reasons
Punishment of the crime
"2012 Highest 2500"
1. At around 17:20 on October 22, 2012, the Defendant: (a) opened a bank owned by the victim F from “E” restaurant located in Heung-gu, Young-gu; and (b) cut off the cash amounting to KRW 125,00,00, KRW 125,000, KRW 1,000, KRW 1, student card, and KRW 3,000,000, at the market price of the victim’s possession.
2. On October 22, 2012, the fraud Defendant presented the credit card in the name of F, as set forth in paragraph 1, to the victim H’s “IS” in the Heung-gu Heung-gu Seoul Metropolitan Government Operation of the Victim H, Cheongju-si, Cheongju-si, to the victim as if he was the Defendant’s credit card.
The Defendant received from the victim the sum total of 18,600 won, such as two cowal scamba, three cars big cans, and two cigarettes, from the victim, and acquired them.
3. The Defendant in violation of the Specialized Credit Financial Business Act presented a credit card at the time, place, as mentioned in paragraph (2), and signed the sales slip and used the stolen credit card.
"2013 Highest 921"
1. Around 10:00 on March 7, 2013, the Defendant acquired a copy of the old bus list equivalent to KRW 9,200 of the market price owned by the victim J, the victim of which was lost at the waiting bus terminal waiting room located in Heung-gu Ho-dong, Young-gu, Chungcheongnam-gu.
The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. On May 8, 2013, the Defendant attempted to larceny: (a) at the “M convenience store managed by the victim L in Heung-gu, Chungcheongnam-gu, Chungcheongnam-gu; and (b) at the “M convenience store” store managed by the victim L, who was displayed in freezing cream by taking advantage of the gap in which the victim’s management was neglected; and (c) at the market price of 4,500 won owned by the victim.
