The following facts may be found either in dispute between the parties or in full view of Gap evidence Nos. 1 through 5, 7, 11, Eul evidence Nos. 1, 2, Eul evidence Nos. 1, 2, and Eul evidence Nos. 1 (including each number, if any; hereinafter the same shall apply), the results of the dispatch of documents to the original district prosecutor's office of this court, and the whole purport of arguments.

The Plaintiff’s president operating the F Women’s Hospital and cook (hereinafter “F Women’s Hospital”) at the window E of Changwon-si, and Defendant C is the president operating the H Women’s Hospital located in Sungwon-si G. Defendant B is a person who works as an assistant nurse at the H Women’s Hospital in Changwon-si, and Defendant B was issued a summary order of KRW 3 million (Seoul District Court Decision 201Da4851) on August 12, 2013 on the ground that he damaged the reputation of the F Women’s Hospital operated by the Plaintiff in violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. and obstructed the Plaintiff’s business by spreading false facts, and at the same time, the said summary order became final and conclusive.

B. The facts constituting the crime of the above summary order are as follows: Defendant B connected Defendant B’s Internet site D (D; hereinafter “D”) with the separate name of “J” using the ID of I who is another employee working at H Women’s Hospital; and Defendant B’s new F Women’s Hospital operated by the Plaintiff may snife the building and have a good impact on the Plaintiff’s flag, and simultaneously interfere with the Plaintiff’s business.
